Section 23 of the Commodity Exchange Act (7 U.S.C. § 26) is the statutory section that created the CFTC Whistleblower Program. The Whistleblower Rules (17 C.F.R. pt. 165) are the rules implementing Section 23 of the Commodity Exchange Act. Both items provide detailed information about the program and rules for whistleblower tip submissions and award applications.
The Whistleblower Rules originally became effective October 24, 2011 and were amended July 31, 2017.
Releases in the Federal Register contain both proposed and final Whistleblower Rules adopted by the CFTC, along with explanatory preambles.
